   الملخص 

تخضع تصرفات الأفراد داخل المجتمعات لقواعد النظام العام والآداب العامة، والتي تشكّل المعيار الأساسي للسلوك السوي أو غير السوي. وقد تتأثر هذه التصرفات بعوامل خارجية، مثل الظروف الاجتماعية، الاقتصادية، والسياسية، إضافةً إلى عوامل داخلية تتعلق بالفرد نفسه، كالحالة النفسية، العقلية، والصحية. في بعض الحالات، قد تؤدي هذه العوامل الداخلية إلى سلوكيات غير متوافقة مع قواعد النظام العام والآداب العامة، مما قد يجعلها في نظر القانون أفعالًا إجرامية تستوجب المساءلة الجزائية، شريطة توفر أركان الجريمة. ويترتب على ذلك فرض عقوبات تختلف في شدتها باختلاف الجريمة المرتكبة.  

ومع ذلك، فإن الاتجاهات الحديثة في علم الجريمة والعقاب تميل إلى مراعاة ظروف التخفيف في بعض الجرائم، لا سيما إذا أثبتت الأدلة أن المتهم كان يواجه ضغوطًا نفسية حادة. وعلى الرغم من أن هذه الضغوط لا تبرر الفعل الجرمي، إلا أنها قد تؤثر على مقدار العقوبة المفروضة. ويعتمد القاضي في ذلك على نتائج الخبرة النفسية التي يجريها خبير مختص، والتي تتيح له تقييم الحالة النفسية للمتهم ومدى تأثيرها على سلوكه.

Abstract  :

The behavior of individuals within societies is subject to the rules of public order and morality, which serve as the fundamental standard for distinguishing between appropriate and inappropriate conduct. These behaviors may be influenced by external factors such as social, economic, and political conditions, as well as internal factors related to the individual, including psychological, mental, and physical conditions. In some cases, these internal factors may lead to behaviors that deviate from the principles of public order and morality, potentially classifying them as criminal acts under the law, provided that the necessary elements of the crime are present. Consequently, penalties are imposed, varying in severity depending on the nature of the offense.  

However, modern trends in criminology and penal policy tend to consider mitigating circumstances in certain crimes, particularly when evidence demonstrates that the accused was experiencing severe psychological distress. While such distress does not justify criminal behavior, it may influence the severity of the punishment imposed. In such cases, the judge relies on psychological expertise provided by a specialized expert, enabling an assessment of the accused's mental state and the extent of its impact on their actions.
