 الملخص:

تبحث هذه الدراسة في السياسة الجنائية العراقية تجاه حقوق المرأة، من خلال تحليل المنظومة القانونية العراقية ومدى انسجامها مع المعايير الدولية ذات الصلة. تسعى الدراسة إلى تقييم فاعلية القوانين النافذة، مثل الدستور، قانون العقوبات، قوانين الأحوال الشخصية، والتشريعات الخاصة بحماية المرأة من العنف، في توفير حماية حقيقية للنساء العراقيات.

ورغم صدور تشريعات متعددة تهدف إلى النهوض بحقوق المرأة، إلا أن الواقع التشريعي والتنفيذي يكشف عن وجود فجوات قانونية، وضعف في آليات التطبيق، واستمرار بعض النصوص التي تتسم بالتمييز. وتُظهر الدراسة أن هذه الإشكالات تتفاقم نتيجة للقيود الاجتماعية والثقافية، وضعف الوعي القانوني، وغياب برامج فعالة لحماية المرأة وإنصافها.

وتوصي الدراسة بإعادة النظر في عدد من النصوص القانونية بما يضمن تعزيز المساواة، وتجريم صريح لجميع أشكال العنف ضد المرأة، وتفعيل دور أجهزة إنفاذ القانون، بالإضافة إلى دعم التعاون بين الدولة والمجتمع المدني لبناء منظومة قانونية عادلة ومنصفة للمرأة العراقية.

Abstract 

This study examines Iraq’s criminal policy regarding women's rights by analyzing the national legal framework and its alignment with relevant international standards. It aims to assess the effectiveness of existing laws—including the Constitution, Penal Code, Personal Status Laws, and laws on violence against women—in providing adequate legal protection for Iraqi women.

Despite the enactment of several legal reforms aimed at promoting women’s rights, the study reveals persistent legal gaps, discriminatory provisions, and weak implementation mechanisms. These shortcomings are exacerbated by social and cultural constraints, limited legal awareness, and the absence of effective protection programs.

The study recommends revising discriminatory legal texts, explicitly criminalizing all forms of violence against women, and strengthening enforcement and accountability structures. It further calls for enhanced cooperation between state institutions and civil society to ensure fair and effective legal protection for women in Iraq.
